Cemetery/Crematorium Representative Activity Reporting 2017-2018

Cemetery and Crematoria NSW (CCNSW) will again collect annual activity data for cemeteries and crematoria. The link to the survey can be found below. All surveys are to be completed by the 24 August 2018.

About the CCNSW Act

Cemeteries & Crematoria NSW have announce that Part 4 of the Cemeteries and Crematoria Act 2013 (the Act) was proclaimed on 25 June 2018. Part 4 of the Act establishes a simplified, consolidated and consistent regime of interment rights across the sector covering public, private and community cemeteries. This is supplemented by additional requirements to support Part 4 of the Act which are contained in the Cemeteries and Crematoria Regulation 2018 (Regulation).

The achievement of this milestone follows the NSW Parliament passing the Act in 2013 as part of a broader range of reforms for the cemeteries and crematoria sector. While most of the Act became operational at that time, Part 4 of the Act was not commenced until further industry and community consultation occurred. This public consultation took place in November and December 2017.

Part 4 of the Act introduces a new, voluntary option of a 25-year renewable interment right, which can be renewed up to a total of 99 years (Renewable Interment Right). The Renewable Interment Right sits alongside the Perpetual Internment Right and gives the people of NSW greater choice. The changes overall provide strong consumer safeguards for interment right holders and mandated requirements to improve accountability of cemetery operators resulting in increased certainty for consumers.

Transitional period

A 12 month transitional period has been approved by the Minister for Lands and Forestry, the Hon Paul Toole MP. Full compliance with the provisions of Part 4 of the Act and the Regulation will not be expected during this period which will enable a measured implementation process to occur. Additional assistance with resources, information and advice will be provided by Cemeteries & Crematoria NSW and Uniting Resources Property Services over the coming months.

Uniting Resources on behalf of Cemetery and Crematoria NSW (CCNSW) is collecting annual activity data for all Uniting Church cemetery and crematoria facilities in NSW.

While CCNSW only covers NSW, Uniting Resources is also requesting that Uniting Church cemetery and crematoria facilities in the ACT also provide the same information to Uniting Resources so as to ensure Property Trust records are up-to-date. All surveys are to be completed by the 24 August 2018.
